Loyalty Program Regulations for Dream Fulfilled Journey
(version effective from 23.05.2018)

DEFINITIONS:
Program Organizer - Nowa Itaka Sp. z o.o. based in Opole 45-072, ul. Reymonta 39.
Dream Fulfilled Journey Program – a loyalty program run by the Organizer, aimed at the Clients of Itaka Travel Agency, who are awarded Points for participating in the Program.
Regulations – these regulations of the Dream Fulfilled Journey Program, which define the rules of the Program.
Participant – a person/entity participating in the Dream Fulfilled Journey Loyalty Program in accordance with the rules of these Regulations.
Program Account Number – an individual account number in the Client Zone, assigned to the Participant by the Program Organizer after completing the form.
Points – points awarded to the Program Participant in accordance with the provisions of these regulations, exchangeable for rewards.
Rewards – tangible rewards that the Program Participant can exchange points for, under the terms specified in these regulations.

  1. GENERAL PROVISIONS
    1. These Regulations define the conditions of the Dream Fulfilled Journey Loyalty Program, hereinafter referred to as the Program, describe the benefits, rights, and obligations of the Participant resulting from participation in the Program.
    2. The Program Organizer and the sponsor of the rewards is Nowa Itaka Sp. z o.o. based in Opole, registered office address: 45 – 072 Opole, ul. Reymonta 39, entered into the register of entrepreneurs kept by the District Court in Opole VIII Commercial Division of the National Court Register under the number 0000002269, NIP 754-26-86-316, REGON 532179139, share capital 3,315,000 PLN, hereinafter referred to as Itaka Travel Agency or Organizer.
    3. The Program is run in the territory of the Republic of Poland and concerns the offer of Itaka Travel Agency.
    4. At the request of the Program Participant, Itaka Travel Agency provides all information regarding the operation of the Program. The Program Participant may submit questions or complaints related to the Program via email to: [email protected]
  2. JOINING THE PROGRAM
    1. Any natural person who is at least 18 years old, has full legal capacity, has a residence address in the Republic of Poland, and has purchased travel services from Itaka Travel Agency can join the Program.
    2. A condition for joining the Program is having an account in the Client Zone and registering for the Program on the website https://www.itaka.pl/strefa-klienta/program-lojalnosciowy.
    3. The Program Participant receives an individual Program Account Number. Each Participant is entitled to only one Program Account Number.
    4. Joining the Program is equivalent to acknowledging the Program Regulations and agreeing to its terms.
  3. POINTS
    1. Points are awarded to the Participant for the purchase and realization of travel services offered by Itaka Travel Agency, depending on the purchase value: one point is awarded for every one hundred zlotys spent.
    2. Points are automatically added at the moment of return from the travel event, exclusively to the Program Participant's account, under whose name the reservation was made, even if the reservation includes more than one person.
    3. Awarded Points cannot be transferred to other persons and cannot be exchanged for cash or discounts.
    4. Points are valid only for reservations that have been realized within the last 10 years, counting from the return date to the present. After 10 years from the end of the trip, the points accrued for that trip expire.
    5. Any complaints regarding the number of Points accumulated in the Program must be reported within 14 days from the date of the event constituting the basis for the change in the number of points. The number of accumulated Points can be checked in the Client Zone on https://www.itaka.pl/strefa-klienta.
    6. Points are not awarded for the purchase of additional services, e.g., local excursions, airline tickets (flights.itaka.pl/), car rentals. The number of points for services that points are awarded for is indicated in the agreement. Group reservations are excluded from the Program.
  4. REWARDS
    1. A detailed list of rewards with the value of Points required to obtain them is available on the website www.itaka.pl/marzenia and in the Client Zone.
    2. For technical reasons, the presented Rewards may differ in appearance from the actual Rewards.
    3. Any public-law burdens related to the exchange of Points for Rewards that may affect the Participant must be settled by the Participant.
    4. The Program Participant redeems the Points by placing an order through the Client Zone. After verifying the Program Participant, Itaka Travel Agency reduces the number of Points accumulated by the Program Participant by the point value of the selected Reward. The Reward is sent to the Program Participant at the address specified in the order within the territory of the Republic of Poland via mail or courier.
    5. For reasons beyond the control of the Organizer, some Rewards may become unavailable, particularly due to their withdrawal by manufacturers or stock depletion and inability to replenish. In such cases, the Organizer will modify the Rewards catalog, taking into account the interests of the Participant.
    6. The Participant is entitled to withdraw from the reward order within 14 days from the date of receipt, without giving any reason. The Participant must inform Itaka Travel Agency of the intention to withdraw and return the received Reward in its original condition.
    7. In the event of defects in Rewards, complaints can be submitted by mail to the address of Itaka Travel Agency or by email to: [email protected]. The complaint processing period is 14 calendar days from the date of receipt. The complaint must include details allowing the identification of the Participant, e.g., name, surname, account number, correspondence address, and a description of the defect.
  5. PERSONAL DATA PROTECTION
    1. The administrator of personal data collected to enable joining and participating in the "Dream Fulfilled Journey" loyalty program is Nowa Itaka Sp. z o.o. based in Opole. Detailed information on personal data processing is available on the website www.itaka.pl/dane-osobowe.
  6. FINAL PROVISIONS
    1. The Program Participant, if they agree, will receive information about special offers via email, phone, SMS.
    2. Itaka Travel Agency has the right to amend the Regulations in cases and to the extent justified by important reasons, i.e., when:
      • The Regulations require adaptation to applicable law or a ruling, decision, or guideline issued;
      • It is required to protect the interests of the Participants;
      • It is justified by the need to ensure the correct and safe operation of the program, including preventing or combating abuses;
      • It is justified by the need to develop the Program's capabilities, with due regard to the interests of the Participants;
    3. In the event of changes to the Regulations, the Organizer will inform the Participant of the modifications via email or SMS and provide the new text of the Regulations on the Program's website (www.itaka.pl/marzenia) and in the Client Zone (www.itaka.pl/strefa-klienta). The method of notification (email or SMS) is decided by the Organizer. Changes are effective for the Participant 30 days from the date of notification and provided that the Participant does not exercise the right to withdraw from the Program during that period.
    4. The Participant can withdraw from the Program at any time by informing the Organizer via email at: [email protected]. Upon withdrawal from the Program, the accumulated Points expire.
    5. Itaka Travel Agency reserves the right to terminate the Program in the event of starting a new loyalty program or other significant reasons. In such a case, Itaka Travel Agency will publish information about the termination of the Program on the Program's website (www.itaka.pl/strefa-klienta), specifying the termination date no less than 3 months before the termination date. During this period, Participants can still accumulate points, and for 6 months from the date of publication of the termination information, they can exchange points for rewards.
